THERE IS NO LAW

Or rather there won't be if this idiotic bill passes tomorrow.

Buried inside a bill that, among other things, moves us well down the road to a national ID card, makes it easier for judges to deport terror "suspects", and drastically tighten the rules on granting political asylum, also deals with a number of border control construction projects. It's one of those typical "throw a million things together into one bill and hope no one notices" tricks both sides love to use to hide pet projects.

Anyhow, as reported by American Prospect's Tapped, buried in the bill is a section that would quite literally make decisions made by the Department of Homeland Security above the law. Here's the pertinent section of the law as they report it:

Section 102(c) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 … is amended to read as follows: “(c) Waiver. —

“(1) In general. — Notwithstanding any other provision of law, the Secretary of Homeland Security shall have the authority to waive, and shall waive, all laws such Secretary, in such Secretary’s sole discretion, determines necessary to ensure expeditious construction of the barriers and roads under this section.

“(2) No judicial review. — Notwithstanding any other provision of law (statutory or nonstatutory), no court shall have jurisdiction —

“(A) to hear any cause or claim arising from any action undertaken, or any decision made, by the Secretary of Homeland Security pursuant to paragraph (1); or

“(B) to order compensatory, declaratory, injunctive, equitable, or any other relief for damage alleged to arise from any such action or decision.”

Correct me if I'm wrong, but... if, at his sole discretion, the Sec. of Homeland Security decides it is, oh, I don't know, necessary to kill a few "suspects" held in custody in order to "ensure expeditious construction of the barriers and roads under this section," there's nothing anyone anywhere would be able to do about it?

I realize I'm being a bit dramatic here, but it's only to illustrate the point that... yes, if he wanted to, he could do PRECISELY THAT if this became law.

WTF? How far off the edge has the GOP gone?

How can anyone support this administration? Anyone?
