NO RATIONAL BASIS

It's a victory for equality. For decency. And for Gavin Newsom!

From the L.A. Times:

"No rational basis exists for limiting marriage in this state to opposite-sex partners," wrote San Francisco Superior Court Judge Richard Kramer.

..snip..

"The idea that marriage-like rights without marriage is adequate smacks of a concept long rejected by the courts: separate but equal," the judge wrote.

Wow! An explicit reference to "separate but equal" in a marriage case. Gotta love that!

Let the hysteria from the far right begin!

UPDATE: The judge that wrote the opinion? A catholic Republican appointed by former governor (and Republican) Pete Wilson. Whoops!

Here's what one of the opponents to gay marriage had to say about the ruling:

"We do not believe it is appropriate for judges in this setting to overturn the will of the people."

Nice standard - sheer majority rule. So... I suppose they oppose school desegregation as well?
