I know I said I wouldn't be back for a few more days, but this news is just to huge to not pass along.
In case you missed it, the Supreme Court just handed down a ruling in Hamdan v. Rumsfeld, and it is a huge - no, make that HUGE - victory for the rule of law and our constitutional system of checks and balances. I hope later today to come back with some excerpts of the decision itself, but until then, SCOTUS Blog has an excellent early analysis of the far reaching implications of this decision. The Court has now gone on record declaring much of this administration's detainee policy unconstitutional, and, as Andrew Sullivan has noticed, put the administration on notice for its more widespread patterns of executive overreach in general.
I know blogs tend to hyperventilate about events, but in this case I'm not sure its possible to overestimate the importance of this decision. If the interpretations I've read of this decision so far are correct, it will force a showdown with the administration. Either they change their policies to conform to the decision, or they ignore the Court and ignite a constitutional crisis. That said, until I've read the text of the decision for myself, I don't want to push this too far. So for now, I leave you in the care of others.
