By a vote of 51-48, the Senate has defeated the amendment to preserve habeas corpus.
Republican Senators Chafee (RI), Sununu (NH), Specter (PA), and Smith (OR) broke with their party to vote in favor of the amendment, while Nelson (NE) was the only Democrat who voted to oppose. Sen Snowe (R-ME), for some reason, did not cast a vote at all.
UPDATE: For the record, here's how the House voted on passage of the entire bill yesterday late afternoon. Why 34 Democrats broke ranks in support of this bill is simply beyond me.
