The Taguba Report Returns

Andrew Sullivan is right: justice is coming.

Gen. Taguba's report on the abuses at Abu Ghraib prison was what finally made both the public and the congress begin to pay at least limited attention to the issue of torture. After two years, Taguba is finally breaking his silence on what he learned, how he learned it, and most importantly, what he was not allowed to say. Sy Hersh and the New Yorker:

Taguba had submitted more than a dozen copies of his report through several channels at the Pentagon and to the Central Command headquarters, in Tampa, Florida, which ran the war in Iraq. By the time he walked into Rumsfeld’s conference room, he had spent weeks briefing senior military leaders on the report, but he received no indication that any of them, with the exception of General Schoomaker, had actually read it. (Schoomaker later sent Taguba a note praising his honesty and leadership.) When Taguba urged one lieutenant general to look at the photographs, he rebuffed him, saying, “I don’t want to get involved by looking, because what do you do with that information, once you know what they show?”


...I learned from Taguba that the first wave of materials included descriptions of the sexual humiliation of a father with his son, who were both detainees. Several of these images, including one of an Iraqi woman detainee baring her breasts, have since surfaced; others have not. (Taguba’s report noted that photographs and videos were being held by the C.I.D. because of ongoing criminal investigations and their “extremely sensitive nature.”) Taguba said that he saw “a video of a male American soldier in uniform sodomizing a female detainee.” The video was not made public in any of the subsequent court proceedings, nor has there been any public government mention of it. Such images would have added an even more inflammatory element to the outcry over Abu Ghraib. “It’s bad enough that there were photographs of Arab men wearing women’s panties,” Taguba said...

Rumsfeld, in his appearances before the Senate and the House Armed Services Committees on May 7th, claimed to have had no idea of the extensive abuse. “It breaks our hearts that in fact someone didn’t say, ‘Wait, look, this is terrible. We need to do something,’ ” Rumsfeld told the congressmen. “I wish we had known more, sooner, and been able to tell you more sooner, but we didn’t.”

Rumsfeld told the legislators that, when stories about the Taguba report appeared, “it was not yet in the Pentagon, to my knowledge.” As for the photographs, Rumsfeld told the senators, “I say no one in the Pentagon had seen them”; at the House hearing, he said, “I didn’t see them until last night at 7:30.” Asked specifically when he had been made aware of the photographs, Rumsfeld said:


There were rumors of photographs in a criminal prosecution chain back sometime after January 13th . . . I don’t remember precisely when, but sometime in that period of January, February, March. . . . The legal part of it was proceeding along fine. What wasn’t proceeding along fine is the fact that the President didn’t know, and you didn’t know, and I didn’t know.

“And, as a result, somebody just sent a secret report to the press, and there they are,” Rumsfeld said.

Taguba, watching the hearings, was appalled. He believed that Rumsfeld’s testimony was simply not true. “The photographs were available to him—if he wanted to see them,” Taguba said. Rumsfeld’s lack of knowledge was hard to credit. Taguba later wondered if perhaps Cambone had the photographs and kept them from Rumsfeld because he was reluctant to give his notoriously difficult boss bad news. But Taguba also recalled thinking, “Rumsfeld is very perceptive and has a mind like a steel trap. There’s no way he’s suffering from C.R.S.—Can’t Remember Shit. He’s trying to acquit himself, and a lot of people are lying to protect themselves.” It distressed Taguba that Rumsfeld was accompanied in his Senate and House appearances by senior military officers who concurred with his denials.

“The whole idea that Rumsfeld projects—‘We’re here to protect the nation from terrorism’—is an oxymoron,” Taguba said. “He and his aides have abused their offices and have no idea of the values and high standards that are expected of them. And they’ve dragged a lot of officers with them.”

...During the next two years, Taguba assiduously avoided the press, telling his relatives not to talk about his work. Friends and family had been inundated with telephone calls and visitors, and, Taguba said, “I didn’t want them to be involved.” Taguba retired in January, 2007, after thirty-four years of active service, and finally agreed to talk to me about his investigation of Abu Ghraib and what he believed were the serious misrepresentations by officials that followed. “From what I knew, troops just don’t take it upon themselves to initiate what they did without any form of knowledge of the higher-ups,” Taguba told me. His orders were clear, however: he was to investigate only the military police at Abu Ghraib, and not those above them in the chain of command. “These M.P. troops were not that creative,” he said. “Somebody was giving them guidance, but I was legally prevented from further investigation into higher authority. I was limited to a box.”

Believe it or not, those quotes are only the beginning, taken from pages one and two of a nine page article online. Taguba directly and by name implicates senior members of both the military and civilian chains of command, including former SecDef Donald Rumsfeld himself.

All of this reinforces once again one of the most frequent themes of this blog: because both the motives and actions of individual human beings can and often will be misguided, the design of our institutions must be both smart and strong. But that point really was Madison's, not mine, so why not let him make it?

If men were angels, no government would be necessary. If angels were to govern men, neither external nor internal controls on government would be necessary. In framing a government which is to be administered by men over men, the great difficulty lies in this: you must first enable the government to control the governed; and in the next place oblige it to control itself. A dependence on the people is, no doubt, the primary control on the government; but experience has taught mankind the necessity of auxiliary precautions.

Later in Hersh's article, no less than Richard Armitage reinforces this very same point:

Richard Armitage, the former Deputy Secretary of State, told me that, on his visits to Iraq, he increasingly found that “the commanders would say one thing and the guys in the field would say, ‘I don’t care what he says. I’m going to do what I want.’ We’ve sacrificed the chain of command to the notion of Special Operations and GWOT”—the global war on terrorism. “You’re painting on a canvas so big that it’s hard to comprehend,” Armitage said.

Armitage is right. The problem isn't just orders and operations within military or the DOD; it is the entire concept of a "war" on "terror." That and, of course, the idea of an all powerful executive in the time of such a "war."

An aggressive congressional inquiry into Abu Ghraib could have provoke unwanted questions about what the Pentagon was doing, in Iraq an elsewhere, and under what authority. By law, the President must make a forma finding authorizing a C.I.A. covert operation, and inform the senior leadership o the House and the Senate Intelligence Committees. However, the Bus Administration unilaterally determined after 9/11 that intelligence operation conducted by the military—including the Pentagon’s covert task forces—for th purposes of “preparing the battlefield” could be authorized by the President, a Commander-in-Chief, without telling Congress.

Madison would of course have found such an interpretation of the constitution absurd. Again, for the record, Federalist 69:

The President is to be the ``commander-in-chief of the army and navy of the United States, and of the militia of the several States, when called into the actual service of the United States..." In most of these particulars, the power of the President will resemble equally that of the king of Great Britain and of the governor of New York.


The most material points of difference are these: First. The President will have only the occasional command of such part of the militia of the nation as by legislative provision may be called into the actual service of the Union. The king of Great Britain and the governor of New York have at all times the entire command of all the militia within their several jurisdictions. In this article, therefore, the power of the President would be inferior to that of either the monarch or the governor.

Secondly. The President is to be commander-in-chief of the army and navy of the United States. In this respect his authority would be nominally the same with that of the king of Great Britain, but in substance much inferior to it. It would amount to nothing more than the supreme command and direction of the military and naval forces, as first General and admiral of the Confederacy; while that of the British king extends to the DECLARING of war and to the RAISING and REGULATING of fleets and armies, all which, by the Constitution under consideration, would appertain to the legislature...

Notice that Madison explicitly separates "commanding" and "directing" the military from "raising" and "regulating" it. Although the first two belong to the president, the last two belong to congress. Bush's actions here, it could and should be argued, violate not only standing federal law but the constitution itself.

Last but not least, a reminder about the importance of leadership:

The President’s failure to act decisively resonated through the military chain of command: aggressive prosecution of crimes against detainees was not conducive to a successful career...


“They always shoot the messenger,” Taguba told me. “To be accused of being overzealous and disloyal—that cuts deep into me. I was being ostracized for doing what I was asked to do.”

Taguba went on, “There was no doubt in my mind that this stuff”—the explicit images—“was gravitating upward. It was standard operating procedure to assume that this had to go higher. The President had to be aware of this.” He said that Rumsfeld, his senior aides, and the high-ranking generals and admirals who stood with him as he misrepresented what he knew about Abu Ghraib had failed the nation.

“From the moment a soldier enlists, we inculcate loyalty, duty, honor, integrity, and selfless service,” Taguba said. “And yet when we get to the senior-officer level we forget those values. I know that my peers in the Army will be mad at me for speaking out, but the fact is that we violated the laws of land warfare in Abu Ghraib. We violated the tenets of the Geneva Convention. We violated our own principles and we violated the core of our military values. The stress of combat is not an excuse, and I believe, even today, that those civilian and military leaders responsible should be held accountable.”

Eventually, Gen. Taguba, because of men like you they will be.

UPDATE: Lest you think my optimism is unwarranted, remember that this is but one of the many ways in which the truth is slowly working its way towards the light. Here, for example, is one more example of how things are finally beginning to turn.
